Biography:

John P. Flynn is a founding Partner of Dioguardi Flynn LLP. He focuses his practice in the areas of civil and commercial litigation and risk management, with an emphasis on representing Internet-based businesses, real estate, insurance, and finance companies. John’s practice areas include copyright (including, but not limited to the Digital Millennium Copyright Act (“DMCA”) and the Communications Decency Act (“CDA”)), trademark, real estate/construction, employment/labor, insurance bad faith and coverage disputes, corporate divorce, officers’ and directors’ liability, and administrative law (primarily in the areas of insurance and labor law). John is sensitive to the expense associated with litigation and works aggressively to ensure disputes are resolved in advance of litigation wherever possible. If litigation ensues, John and his team pursue or defend those actions in as cost-effective a manner as practicable while working tirelessly to ensure the client’s business needs and goals are met. John frequently works via creative billing arrangements such as modified hourly/contingent, or success fee driven representation where the client’s financial model may be aligned with the Firm’s to offer the best representation relationship possible in an ever-evolving and changing legal and business market.

John counsels and represents businesses in all areas of risk management in the area of business exposure, contracts, operations, and employment and labor. In the intellectual property litigation arena, John regularly represents companies in their efforts to protect their assets and ensure proper business operations, including maintaining compliance with the DMCA - a component of the federal copyright laws that impacts all businesses with an Internet presence or operation. John was lead counsel in the seminal DMCA case Perfect 10, Inc. v. CCBill, LLC, 340 F. Supp. 2nd 1077 (C.D. Cal. 2004), aff’d in part, 488 F.3d 1102 (9th Cir. 2007), cert. denied, 129 S. Ct. 709 (2007) (affirming judgment for defendant ISP under the DMCA and CDA). John’s civil litigation practice includes representation of web hosting, Internet payment processing, real estate, finance, title/escrow, insurance, construction and healthcare businesses. Recently, John served as Plaintiff’s co-counsel in an Arizona state court case involving Internet billing and intermediary services, Media Services Limited v. June An et al., CV 2004-005095, resulting in a jury verdict for the Plaintiff in excess of $14,000,000.

In the context of employment law, John counsels and represents employers in all aspects of employment law pertaining to discrimination (including the ADEA, ADA, and Title VII claims and compliance), harassment, retaliation, wage and hour compliance, the Family and Medical Leave Act, drafting of policies and procedures manuals, employment related contracts, enforcing employment covenants, and employer discipline and investigations. John has litigated employment law matters throughout the country, with significant experience before the State and Federal agencies, including the EEOC, Department of Labor, Civil Rights Section of the Arizona Attorney General’s Office, and the Arizona Department of Economic Security. John routinely represents clients in the defense or pursuit of regulatory and resulting litigation matters.

John’s casework also includes analyzing complex statutory/regulatory issues relating to licensing, insolvency, consumer complaint investigations and matters arising before the Arizona Department of Insurance and its sister-state agencies. John has significant experience litigating matters before the ADOI, the Office of Administrative Hearings, and the appeals of such actions in the State Courts,, up to and including the Arizona Supreme Court.
